Nov\u011b budou muset firmy sv\u00e9 zam\u011bstnance informovat, \u017ee je jejich elektronick\u00e1 po\u0161ta monitorov\u00e1na, o \u010dem\u017e rumunsk\u00fd zam\u011bstnanec nem\u011bl ani tu\u0161en\u00ed. Podle intern\u00edch pravidel firmy ale je zak\u00e1z\u00e1no vyu\u017e\u00edvat firemn\u00ed po\u010d\u00edta\u010d k soukrom\u00fdm \u00fa\u010del\u016fm.&#13; &#13; Propu\u0161t\u011bn\u00fd rumunsk\u00fd in\u017een\u00fdr si st\u011b\u017eoval na \u00fadajn\u00e9 \u0161pehov\u00e1n\u00ed ze strany zam\u011bstnavatele a sebe ozna\u010dil ob\u011bt\u00ed poru\u0161en\u00ed pr\u00e1va na soukrom\u00fd \u017eivot a korespondenci, kter\u00e9 je obsa\u017eeno v Evropsk\u00e9 \u00famluv\u011b o lidsk\u00fdch pr\u00e1vech.&#13; Nejd\u0159\u00edve se p\u0159\u00edpad \u0159e\u0161il u rumunsk\u00fdch soud\u016f a stejn\u011b jako zpo\u010d\u00e1tku ve \u0160trasburku ve prosp\u011bch firmy. Nyn\u00ed byl zru\u0161en verdikt z minul\u00e9ho roku, ve kter\u00e9m bylo sledov\u00e1n\u00ed zam\u011bstnavatelem od\u016fvodn\u011bno t\u00edm, \u017ee se pouze cht\u011bl ujistit, \u017ee zam\u011bstnanci b\u011bhem pracovn\u00ed doby pln\u00ed sv\u00e9 povinnosti a nev\u011bnuj\u00ed se jin\u00fdm \u010dinnostem, kter\u00e9 by je mohly od nich zdr\u017eovat.&#13; Podle soudc\u016f ve Velk\u00e9m sen\u00e1tu rumunsk\u00e9 soudy nechr\u00e1nily dostate\u010dn\u011b pr\u00e1vo na soukrom\u00ed propu\u0161t\u011bn\u00e9ho in\u017een\u00fdra a nezajistily spravedliv\u00fd st\u0159ed mezi ob\u011bma z\u00e1jmy. K takov\u00e9mu z\u00e1v\u011bru do\u0161el sedmn\u00e1cti\u010dlenn\u00fd sen\u00e1t v pom\u011bru 11:6.&#13; &#13; Zam\u011bstnavatel mus\u00ed m\u00edt d\u016fvod ke kontrole&#13; Soud rozhodl, \u017ee jestli bude firma monitorovat korespondenci sv\u00fdch zam\u011bstnanc\u016f, mus\u00ed b\u00fdt o mo\u017en\u00e9 kontrole b\u00fdt zam\u011bstnanci v\u010das informov\u00e1ni. Nav\u00edc mus\u00ed m\u00edt zam\u011bstnavatel ke ka\u017ed\u00e9 kontrole d\u016fvod, a pokud zjist\u00ed poru\u0161en\u00ed pravidel pou\u017eit\u00ed pracovn\u00edch komunika\u010dn\u00edch kan\u00e1l\u016f, d\u016fsledky by m\u011bly b\u00fdt m\u00edrn\u011bj\u0161\u00ed, ne\u017e v\u00fdpov\u011b\u010f.&#13; Tento verdikt ESPL se t\u00fdk\u00e1 rumunsk\u00e9ho p\u0159\u00edpadu, ale bude m\u00edt dopad na v\u0161ech 46 \u010dlensk\u00fdch zem\u00ed Rady Evropy.
